Communication Agreement

Updates to this Electronic Communication Agreement will be dated and can be reviewed on Swivel Transactions, LLC website (). 

This agreement is made and entered into by and between Swivel Transactions, LLC and you, the account holder. The terms “you” and “your” refer to the individual who has applied for, accepted, or utilized an Swivel Transactions, LLC Account, including any authorized user of the account; Swivel Transactions, LLC Accounts include, but not limited to: ECM Account and Merchant Account.

Reservation of Right to Utilize Other Methods of Communication

Swivel Transactions, LLC reserves the right to use all lawful methods of communication and shall provide legal notices and other documents and communications in paper form when legally required to do so or when we, Swivel Transactions, LLC, in our sole discretion, elects to do so.

Electronic Delivery of Communications

You agree and consent to receive electronically all communications, agreements, documents, notices and disclosures (collectively referred to as “Communications”) that Swivel Transactions, LLC provides in connection with your Swivel Transactions, LLC accounts and services. Communications include:

  • Agreements, applications, and policies you agree to
  • Disclosures
  • Transaction information
  • Statements; including tax statements 

Swivel Transactions, LLC will provide these Communications to you by posting them on the Swivel Transactions, LLC website and/or by emailing them to you at the email address(es) specified in your Application or provided by you to Swivel Transactions, LLC.

Hardware & Software Requirements

In order to access electronic Communications, you will need, at minimum, the following hardware and software:

  • Computer/laptop/other appropriate device
  • Internet connection
  • Current web browser (e.g., Internet Explorer, Chrome, Safari) 
  • Valid email address
  • Sufficient storage space to save Communications or installed printer to print documents

By giving your consent, you are confirming that you have access to the necessary equipment, software and connection and are able to receive, open, print or download a copy of any Communication for future retrieval. You may save or print a copy of these Communications for your records, as the Communications may not be accessible online at a later date.

Updating Your Contact Information

It is your responsibility to keep your primary contact information (e.g., email address) up-to-date so that Swivel Transactions, LLC can communicate with you electronically. You understand and agree that if Swivel Transactions, LLC sends you an electronic Communication and you do not receive it because your email address on file has changed, is incorrect, out-of-date, blocked by your organization/service provider, or you are otherwise unable to receive electronic Communications, Swivel Transactions, LLC will be deemed to have provide the Communication to you. You agree to provide Swivel Transactions, LLC with notice of any change to your email address. In addition, you agree to be bound by any Communications sent to you by Swivel Transactions, LLC at the last email address provided by you to Swivel Transactions, LLC. If you or your organization utilizes a spam filter that re-routes or blocks emails from senders not listed in your email address book, you must add Swivel Transactions, LLC to your email address book so that you will be able to receive the Communications Swivel Transactions, LLC send to you.
